Customer Agreement

1. Agreement to Terms

By registering as a Customer on the Neighbour NL platform ("the Platform"), you agree to be bound by this Customer Agreement, the Neighbour NL Terms of Service, and the Privacy Policy. You must accept this Agreement before posting a job.

2. Nature of the Platform

Neighbour NL is a technology platform that connects customers with independent service providers. Neighbour NL is not the provider of any services listed on the Platform. All services are performed by independent third-party contractors, not by Neighbour NL.

You are hiring an independent service provider, not an employee or agent of Neighbour NL. Neighbour NL does not perform services, employ Workers, supervise or control how services are performed, set Worker schedules, provide Worker equipment, or guarantee the outcome of any job.

Neighbour NL's role is limited to: operating the Platform, facilitating payment processing, providing a dispute reporting mechanism, and maintaining community standards. Any service agreement is solely between you and the Worker you hire.

3. Your Responsibility to Assess Workers

You are responsible for determining whether a Worker is suitable for the task you are posting. Neighbour NL provides ratings and reviews to assist you, but does not independently verify Worker qualifications, skills, licences, or background.

Neighbour NL does not conduct criminal background checks, reference checks, or any other form of screening on Workers. You acknowledge this limitation and accept responsibility for your decision to hire any Worker through the Platform.

Before hiring a Worker, you should consider:

  • The Worker's ratings and reviews from previous jobs;
  • Whether the task requires any specific qualifications or licences;
  • Whether the task involves access to your home, property, or personal belongings.

4. Assumption of Risk

By hiring a Worker through the Platform, you voluntarily assume all risks associated with inviting an independent contractor onto your property or into your home. This includes, but is not limited to, risks of personal injury, property damage, theft, or other loss.

Neighbour NL is not present during the performance of any job and has no ability to supervise, monitor, or control the conduct of Workers. You acknowledge that you are making an independent decision to allow a Worker access to your property and that Neighbour NL bears no responsibility for any resulting harm, loss, or damage.

5. Safe Work Environment

You agree to provide a reasonably safe work environment for any Worker performing services at your property. This includes:

  • Disclosing any known hazards relevant to the job;
  • Ensuring the work area is accessible and reasonably safe;
  • Complying with any applicable health and safety requirements.

6. Accurate Job Descriptions

You are responsible for providing an accurate and complete description of the job you are posting. If the actual scope of work is materially different from what was described in the job posting, you accept responsibility for any resulting dispute, additional cost, or refusal by the Worker to complete the job.

Neighbour NL is not responsible for disputes arising from inaccurate, incomplete, or misleading job descriptions.

7. Property Damage

Any claim for property damage arising from work performed by a Worker is a matter between you and the Worker. Neighbour NL is not liable for any damage to your property, belongings, or premises caused by a Worker.

If you believe a Worker has damaged your property, you should document the damage and raise a dispute within the 24-hour review period. Neighbour NL may, at its sole discretion, assist in facilitating communication between the parties, but is not obligated to do so and does not guarantee any particular outcome or compensation.

8. Payment

When you post a job, you submit payment through the Platform at the time of posting. Funds are held securely until the job is completed.

After the job is performed, you have 24 hours to confirm completion or report an issue. If no action is taken within 24 hours, payment is automatically released to the Worker.

The Platform retains a service commission from the job price. The commission rate is set out in the Terms of Service and Worker Agreement. Payment processing fees may also apply.

9. Cancellation and Refunds

Before a Worker Claims the Job

If you cancel a job before any Worker has claimed it, you are entitled to a full refund of the job price, less any non-refundable payment processing fees charged by the Platform's payment provider.

After a Worker Claims the Job

If you cancel a job after a Worker has claimed it, a cancellation fee of $10.00 applies. Of this fee, $5.00 is paid to the Worker as compensation for their time and commitment, and $5.00 is retained by the Platform. The remainder of the job price (less payment processing fees) will be refunded to you.

After a Job is Completed

Once a Worker has marked a job complete and the 24-hour review period has passed without a dispute, payment is automatically released to the Worker and is no longer eligible for refund except at the sole discretion of Neighbour NL in cases of verified fraud or material misrepresentation.

Raising a Dispute

If you are unsatisfied with the work performed, you must report the issue within the 24-hour review window following the Worker marking the job complete. Neighbour NL will review disputes at its sole discretion and may issue a full or partial refund where the dispute is substantiated. Neighbour NL does not guarantee any particular outcome.

Worker Abandonment

If a Worker abandons or fails to complete a claimed job without reasonable cause, you are entitled to a full refund of the job price, less any non-refundable payment processing fees.

Refund Processing

Refunds are returned to the original payment method. Processing times depend on your financial institution and may take 5–10 business days to appear. Neighbour NL does not issue cash refunds.

10. No Guarantee of Outcomes

Neighbour NL does not guarantee:

  • That a Worker will claim your job;
  • That a job will be completed to your satisfaction;
  • The quality, timeliness, or suitability of services performed;
  • That a Worker holds any particular licence, certification, or insurance.

11. Prohibited Use

You agree not to post jobs that are unlawful, dangerous, or that require services outside the scope of what the Platform supports. You agree not to circumvent the Platform's payment system by arranging direct payment with a Worker.

12. Indemnification

You agree to indemnify, defend, and hold harmless Neighbour NL, its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Platform, your conduct, or your breach of this Agreement.

13. Governing Law

This Agreement is governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein.
