Neighbour NL ("the Platform," "we," "us," or "our") is an online technology marketplace that connects customers who need help with tasks with independent service providers ("Workers") who are willing to perform those tasks for compensation.
Neighbour NL does not perform services. Neighbour NL does not employ Workers. Neighbour NL does not supervise, direct, or control the work performed by Workers. Customers decide whether to hire a Worker. Workers decide whether to accept a job.
By accessing or using the Platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
Neighbour NL is a technology platform only. All services listed on the Platform are performed by independent third-party service providers, not by Neighbour NL.
You must be at least 18 years of age to create an account and use the Platform. By registering, you represent that you meet this requirement and that all information you provide is accurate and complete.
To use the Platform, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Customers must click "I agree to the Terms of Service" and the Customer Agreement before registering.
Workers must click "I agree to the Terms of Service" and the Worker Agreement before receiving jobs.
All payments are processed through the Platform. When a Customer posts a job:
Neighbour NL will not manually send payments to Workers. Workers must connect a bank account through the payment provider and complete any required identity verification.
After a job is performed, the Customer has 24 hours to either confirm completion or report an issue. If no action is taken within 24 hours, payment is automatically released to the Worker.
Neighbour NL may, at its sole discretion, assist in resolving disputes between Customers and Workers, but is under no obligation to do so and makes no guarantee of any particular outcome.
Before a Worker Claims the Job
If a Customer cancels a job before any Worker has claimed it, the Customer is entitled to a full refund of the job price, less any non-refundable payment processing fees charged by the Platform's payment provider.
After a Worker Claims the Job
If a Customer cancels a job after a Worker has claimed it, a cancellation fee of $10.00 applies. Of this fee, $5.00 is paid to the Worker as compensation for their time and commitment, and $5.00 is retained by the Platform. The remainder of the job price (less payment processing fees) will be refunded to the Customer.
After a Job is Completed
Once a Worker has marked a job complete and the 24-hour review period has passed without a dispute, payment is automatically released to the Worker and is no longer eligible for refund except at the sole discretion of Neighbour NL in cases of verified fraud or material misrepresentation.
Disputed Jobs
If a Customer raises a dispute within the 24-hour review window, Neighbour NL will review the dispute at its sole discretion. Refunds may be issued in whole or in part where the dispute is substantiated. Neighbour NL does not guarantee any particular outcome. Payment processing fees may be non-refundable.
Worker Cancellations
If a Worker abandons or fails to complete a claimed job without reasonable cause, the Customer is entitled to a full refund of the job price, less any non-refundable payment processing fees. Repeated Worker cancellations may result in account suspension.
Platform Cancellations
Neighbour NL reserves the right to cancel any job at any time where it determines that a violation of these Terms has occurred, where safety concerns exist, or where it is otherwise necessary to protect the integrity of the Platform. In such cases, Neighbour NL will issue refunds at its discretion.
Refunds are processed to the original payment method. Processing times depend on the Customer's financial institution and may take 5–10 business days to appear. Neighbour NL is not responsible for delays caused by the Customer's bank or card issuer.
Neighbour NL does not issue cash refunds. All refunds are returned to the original payment method used at the time of job posting.
You agree not to:
Off-Platform Transactions. Any transaction, arrangement, or agreement made between a Customer and a Worker outside of the Platform is entirely at the parties' own risk. Neighbour NL bears no responsibility or liability whatsoever for any off-platform transaction, including any payment made, work performed, injury sustained, or property damage arising from such arrangements.
Both Customers and Workers may leave ratings and reviews after a job is completed. Reviews must be honest and based on actual experience. Neighbour NL reserves the right to remove reviews that violate these Terms.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. Neighbour NL does not guarantee:
Neighbour NL does not provide liability insurance, workers' compensation coverage, vehicle insurance, or health benefits to independent service providers or customers. Workers and Customers are solely responsible for obtaining any insurance coverage they deem appropriate.
To the maximum extent permitted by applicable law, Neighbour NL's total liability arising from or related to your use of the Platform shall be limited to the amount of platform fees paid to Neighbour NL in connection with the applicable transaction.
In no event shall Neighbour NL be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, personal injury, or property damage.
You agree to indemnify, defend, and hold harmless Neighbour NL, its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
Neighbour NL reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users, the Platform, or third parties.
Neighbour NL may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.
Neighbour NL reserves the right, at any time and without notice or liability, to modify, suspend, or discontinue the Platform or any feature, service, or functionality offered through it. Neighbour NL shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.
By uploading photos, text, or other content to the Platform ("User Content"), you grant Neighbour NL a non-exclusive, royalty-free, worldwide licence to store, display, and use that content solely for the purpose of operating and improving the Platform.
You represent and warrant that you own or have the necessary rights to upload your User Content and that it does not violate any applicable law or third-party rights. Neighbour NL is not responsible for any User Content uploaded by users and reserves the right to remove content that violates these Terms.
Neighbour NL shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, power outages, internet or telecommunications failures, third-party service provider outages (including payment processors), government actions, pandemics, or any other event outside Neighbour NL's reasonable control.
Before initiating any legal proceeding, you agree to first attempt to resolve any dispute with Neighbour NL informally by contacting us at [email protected]. Both parties agree to make a good-faith effort to resolve the dispute within 30 days of the initial notice. If the dispute is not resolved within that period, either party may pursue available legal remedies.
Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
These Terms of Service, together with the applicable Customer Agreement or Worker Agreement and the Privacy Policy, constitute the entire agreement between you and Neighbour NL with respect to your use of the Platform and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to the subject matter herein.
These Terms are governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Newfoundland and Labrador.
