Worker Agreement

1. Agreement to Terms

By registering as a Worker on the Neighbour NL platform ("the Platform"), you agree to be bound by this Worker Agreement, the Neighbour NL Terms of Service, and the Privacy Policy. You must accept this Agreement before you can receive or claim jobs through the Platform.

Important: Neighbour NL is a technology platform only. Neighbour NL is not your employer. You are an independent contractor. Neighbour NL does not perform services, does not supervise your work, and is not the provider of the services you offer through the Platform.

2. Independent Contractor Status

You are an independent contractor, not an employee of Neighbour NL. This Agreement does not create an employment relationship, partnership, joint venture, agency, franchise, or any other relationship between you and Neighbour NL.

Neighbour NL does not:

  • Assign you to jobs — you choose which jobs to accept;
  • Set your schedule — you work when you choose;
  • Supervise, direct, or control how you perform services;
  • Provide you with equipment, tools, or supplies;
  • Train you on how to perform services.

3. Tax Responsibilities

You are solely responsible for all taxes arising from your earnings through the Platform. This includes, but is not limited to, federal and provincial income tax, HST/GST (if applicable), and any other taxes or remittances required by law.

Neighbour NL will not withhold income tax, CPP contributions, or EI premiums from your earnings. You are responsible for tracking your income and remitting all required amounts to the Canada Revenue Agency and the Government of Newfoundland and Labrador.

We recommend consulting a tax professional to understand your obligations as a self-employed individual.

4. Equipment and Tools

You are responsible for providing your own equipment, tools, and supplies necessary to perform the services you offer. Neighbour NL does not provide, lend, or reimburse you for any equipment or materials.

5. Transportation

You are responsible for your own transportation to and from job locations. Neighbour NL does not provide transportation or reimburse transportation costs. You are responsible for ensuring your vehicle is properly insured for the purposes for which it is used.

6. Licences and Insurance

You are responsible for obtaining any licences, permits, certifications, or insurance coverage required by law or reasonably necessary to perform the services you offer.

Neighbour NL does not provide liability insurance, workers' compensation coverage, vehicle insurance, or health benefits to Workers. You are solely responsible for any claims, damages, or losses arising from your work.

7. Background Checks

Neighbour NL does not conduct criminal background checks, reference checks, or any other form of screening on Workers. By registering as a Worker, you represent that you are legally permitted to work in Canada and that you have no undisclosed criminal history that would make it unsafe or inappropriate for you to perform the services you offer.

Neighbour NL makes no representation to Customers that Workers have been screened, vetted, or verified in any way beyond the information provided on the Platform.

8. No Guarantee of Work

Neighbour NL does not guarantee any volume of jobs, income, or continued availability of the Platform. The availability of jobs depends entirely on Customer demand in your area. Neighbour NL makes no representation that you will earn any particular amount or receive any minimum number of job opportunities through the Platform.

You acknowledge that you are not relying on the Platform as a guaranteed or primary source of income, and that Neighbour NL may modify, suspend, or discontinue the Platform at any time without liability to you.

9. Completion Photos and Job Evidence

For certain service categories, you may be required to submit one or more photos as evidence of job completion before payment is released. By submitting completion photos, you confirm that the work depicted was performed by you at the Customer's location as part of the posted job.

Submitting false, misleading, or fabricated completion photos constitutes a material breach of this Agreement and may result in immediate account suspension, withholding of payment, and referral to appropriate authorities.

10. Teen Worker Accounts

Workers under the age of 18 ("Teen Workers") may register on the Platform with the consent and participation of a parent or legal guardian ("Guardian"). By registering a Teen Worker account, the Guardian:

  • Confirms they are the Teen Worker's parent or legal guardian;
  • Accepts this Agreement and all Platform Terms on behalf of the Teen Worker;
  • Acknowledges that all payments for jobs completed by the Teen Worker will be directed to the Guardian's connected payment account;
  • Accepts full responsibility for the Teen Worker's conduct on and off the Platform in connection with any job;
  • Acknowledges that Teen Worker accounts require admin approval before the Teen Worker may claim jobs.

Neighbour NL reserves the right to restrict Teen Workers from certain service categories based on age-appropriateness or safety considerations.

11. Payment

Payment for completed jobs is processed through the Platform. Upon confirmation of job completion (or after the 24-hour review period with no dispute), the Platform will release payment to you, less the Platform's commission of 20% and any applicable payment processing fees.

To receive payment, you must:

  • Connect your bank account through the Platform's payment provider;
  • Complete any identity verification required by the payment provider;
  • Maintain accurate and up-to-date payment information.

Neighbour NL will not manually send payments to Workers.

12. Cancellation Policy

Worker-Initiated Cancellations

If you claim a job and subsequently abandon it or fail to complete it without reasonable cause, the Customer is entitled to a full refund. Repeated cancellations or abandonments may result in account suspension or removal from the Platform.

Customer-Initiated Cancellations (Before Claim)

If a Customer cancels a job before you have claimed it, no compensation is owed to you.

Customer-Initiated Cancellations (After Claim)

If a Customer cancels a job after you have claimed it, you are entitled to receive $5.00 of the $10.00 cancellation fee as compensation for your time and commitment. The remaining $5.00 is retained by the Platform.

Disputes

If a Customer raises a dispute within the 24-hour review window, Neighbour NL may withhold payment pending review. Neighbour NL will assess disputes at its sole discretion. You may be asked to provide evidence of job completion, including photos or other documentation.

13. Conduct and Quality

You agree to:

  • Perform all accepted jobs in a professional and workmanlike manner;
  • Treat Customers and their property with respect;
  • Communicate clearly and promptly with Customers;
  • Only claim jobs you are genuinely able and willing to complete;
  • Comply with all applicable laws and regulations in performing services.

You also agree to comply with the Neighbour NL Community Standards & Safety Policy, which is incorporated into this Agreement by reference.

14. Ratings and Reviews

Customers may rate and review your work after a job is completed. Your ratings are visible to other Customers on the Platform. Neighbour NL reserves the right to suspend or remove accounts with consistently poor ratings or conduct that violates these terms.

15. Indemnification

You agree to indemnify, defend, and hold harmless Neighbour NL, its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your performance of services, your conduct, or your breach of this Agreement.

16. Termination

Either party may terminate this Agreement at any time. Neighbour NL reserves the right to suspend or remove your account for violations of this Agreement or the Terms of Service, or for conduct that is harmful to Customers, other Workers, or the Platform.

17. Governing Law

This Agreement is governed by the laws of the Province of Newfoundland and Labrador and the federal laws of Canada applicable therein.
